- Adaptive revision hub with personalised practice materials
- AI tutor companion for subject-specific questions and support
3. School-Based Access and Account Creation
3.1 Institutional Subscription
- Access to edflow is provided through institutional subscriptions with educational organisations ("Schools")
- Individual user accounts are created through school onboarding processes
- Schools are responsible for managing user access and maintaining current subscription status
3.2 User Account Types
- School Administrators: Manage institutional settings and user access
- Teachers: Access teaching tools, create assessments, and view student performance and class metrics
- Students: Access learning materials, take assessments, and use revision tools
3.3 Account Requirements
- All users must be affiliated with a subscribing educational institution
- Users must provide accurate information during account setup
- Each user is responsible for maintaining the confidentiality of their login credentials
4. Acceptable Use Policy
4.1 Permitted Uses
You may use edflow for legitimate educational purposes including:
- Creating and administering assessments
- Providing educational feedback and instruction
- Tracking academic progress and performance
- Accessing educational content and AI tutoring support
4.2 Prohibited Uses
You may not:
- Share account credentials or allow unauthorised access
- Attempt to circumvent security measures or access restrictions
- Upload malicious code, viruses, or harmful content
- Use the platform to harass, bully, or harm others
- Violate any applicable laws or regulations
- Reverse engineer, modify, or create derivative works of the platform
- Use AI-generated content to violate academic integrity policies without proper disclosure
5. AI and Machine Learning Services
5.1 AI Content Disclaimer
- AI-generated content is provided for educational support and may contain inaccuracies
- Users should verify important information independently
- Teachers maintain responsibility for final assessment decisions
- AI tutoring supplements but does not replace human instruction
6. Data Protection and Privacy
6.1 Student Data Protection
- We comply with applicable Australian privacy laws including the Privacy Act 1988
- Student educational records are protected and used solely for educational purposes
- Schools maintain primary responsibility for student data privacy compliance
- We do not sell or share student personal information for commercial purposes
7. Intellectual Property Rights
7.1 Platform Ownership
- edflow platform, including all software, content, and technology, is owned by the Company
- Users receive a limited, non-exclusive license to use the platform for educational purposes
- This license terminates upon account closure or subscription cancellation
7.2 User-Generated Content
- Schools and users retain ownership of their original educational content
- By using the platform, users grant us a license to process and display their content as necessary for service provision
- Users are responsible for ensuring they have rights to any content they upload
7.3 Educational Content
- NESA-aligned questions and educational materials are licensed for use within the platform
- Users may not extract, redistribute, or use platform content outside of the authorised educational context
8. School Responsibilities
8.1 Subscription Management
Schools are responsible for:
- Maintaining current subscription payments
- Managing user access and permissions
- Ensuring compliance with institutional policies
- Providing accurate user information during onboarding
8.2 Student Supervision
- Schools maintain responsibility for supervising student platform use
- Schools must ensure appropriate use of AI tutoring features
- Academic integrity policies remain under school jurisdiction
- Schools should provide guidance on proper platform usage
8.3 Data Privacy Compliance
- Schools are responsible for obtaining necessary parental consents where required
- Schools must comply with applicable local privacy laws
- Schools should review and approve platform usage within their data governance frameworks
9. Payment Terms
9.1 Subscription Fees
- Access to edflow is provided through school-level subscriptions
- Subscription fees are determined by institutional agreements
- Payment terms are specified in individual school contracts
9.2 Fee Changes
- We reserve the right to modify subscription fees with appropriate notice
- Current subscribers will be notified of fee changes according to their contract terms
- Continued use after fee changes constitutes acceptance of new rates
10. Service Availability and Support
10.1 Service Uptime
- We strive to maintain high service availability but cannot guarantee uninterrupted access
- Scheduled maintenance will be communicated in advance when possible
- Emergency maintenance may occur without prior notice
10.2 Technical Support
- Support is provided to subscribing schools during regular business hours
- Support requests should be submitted through designated school administrators
- We will make reasonable efforts to resolve technical issues promptly
11. Limitation of Liability
11.1 Service Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 Liability Limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY THE SCHOOL FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11.3 Educational Outcomes
- We do not guarantee specific educational outcomes or improvements
- The platform is a tool to support education but cannot replace effective teaching
- Academic results depend on many factors beyond platform usage
12. Indemnification
Schools agree to indemnify and hold harmless the Company from claims arising from:
- Violation of these Terms by school users
- Misuse of the platform by students or staff
- Violation of third-party rights
- Non-compliance with applicable laws or regulations
13. Termination
13.1 Termination by Schools
- Schools may terminate their subscription according to contract terms
- Upon termination, user access will be revoked
- Data export or deletion will be handled according to the schools' data retention policy
13.2 Termination by Company
We may terminate access for:
- Non-payment of subscription fees
- Material breach of these Terms
- Violation of acceptable use policies
- Discontinuation of the service
13.3 Effect of Termination
- Upon termination, all user access ceases immediately
- Schools may request data export within a reasonable timeframe
- Certain provisions of these Terms survive termination
14. Changes to Terms
14.1 Modification Rights
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the platform or notification to subscribing schools.
14.2 Notification Process
- Material changes will be communicated to school administrators
- Continued use after changes constitutes acceptance of modified Terms
- Schools may terminate subscriptions if they disagree with material changes
